Let’s explore the details of the incident with Ehline Law and our personal injury attorneys.
On September 28, 2022, a fatal crash occurred involving a truck and a cyclist Wednesday morning on Highway 1, leaving the cyclist dead.
California Highway Patrol stated that a box truck hit a cyclist on Highway 1 and Cypress Avenue in Moss Beach at about 11:30 AM, resulting in fatal injuries to the cyclist.
For reasons unknown, the trucker, Vincent D. Qualls, drifted into the northbound lane, crossing the double yellow lines, heading the wrong way into oncoming traffic, and struck the cyclist riding on the shoulder. The impact threw the rider off the road into nearby trees.
When the police arrived at the accident scene, they saw the cyclist near the trees who had suffered fatal injuries and died at the crash site.
San Mateo County Coroner’s Office has not identified the dead cyclist, pending notification from the family.
According to California Highway Patrol, the box truck driver suffered minor injuries from the accident.
The Emergency Services transported the truck driver to Seton Medical Center in Daly City for medical attention. Soon after, authorities arrested him on suspicion of involuntary manslaughter.
There is no information available on the factors causing the crash.
Drivers have the duty of care towards all other drivers, motorcyclists, riders, and pedestrians to ensure reasonable care while driving their vehicles and prevent accidents. However, other parties could be responsible for the accident.
In the incident “Cyclist killed by a truck on highway 1”, further investigation needs to be conducted to find the liable party. Police are investigating why the driver drifted into the northbound lane, and any reasons from the investigation could help determine the responsible party.
It could be that the driver was driving under the influence of alcohol or drugs, resulting in a fatal accident.
If that is the case, the driver is responsible as they breached their duty of care. The grieving family may have a wrongful death claim against the box truck driver as their gross negligence resulted in the cyclist’s death, who suffered fatal injuries from the incident.
The accident could also occur because of defective truck parts causing the truck to veer off, causing the collision.
In such a situation, the grieving family may be able to pursue a product defect wrongful death claim, as manufacturers are responsible for ensuring their products are safe before selling to consumers.
In the incident where the box truck driver killed a cyclist in Half Moon Bay, the local government could be responsible for the accident if potholes on the highway caused the trucker to veer off into the wrong lane.
There could be many different causes of the truck-cycle accident, and a proper investigation into the incident can reveal the underlying cause of the incident.
